Texas Sports Betting Legislation

Sports betting is prohibited in Texas by the state’s constitution and other laws. Despite this, there are still options for those interested in wagering online or in retail, namely daily fantasy sports (DFS).

The US Supreme Court decision of Murphy v. National Collegiate Athletic Association overturned a federal ban on sports gambling in 2018, thus allowing individual states to decide whether it’s legal within their jurisdiction. Texas Attorney General reported that paid DFS would be considered illegal gaming in the state, while season-long fantasy leagues may be allowed subject to conditions.

This, however, has not swayed Lt. Gov Dan Patrick, who staunchly opposes any expansion in gambling or sports betting during legislative sessions, making it unlikely that such changes can take effect anytime soon.

Resolutions on the Table

Despite what the governor has said, that doesn’t mean Texans are sitting back and doing nothing. A number of bills have been brought up in the state legislature in recent years.

There is a push to pass a resolution in the 2024 legislative session to make casino and sports betting legal in Texas. Senator Carol Alvarado has been filing similar legislation since 2009, and if successful, Texans will have the opportunity to vote on the issue this year.

Should it pass, sports betting would be restricted to specific locations – Dallas, Austin, Houston, and San Antonio – with four-to-five-star hotels, convention and entertainment complexes, restaurants, and shops.

This could pave the way for further expansion of legalized sports betting across the state, with online sportsbooks and retail outlets receiving much-needed revenue from taxes imposed. However, as of now, there is still a long way to go before such gambling laws are passed.

Daily Fantasy Sports in Texas

The Texas House passed House Bill 2303 in 2019, legalizing fantasy sports as games of skill and therefore deeming them legal.

This allows fans to draft real players from various sporting leagues to create a fictional team, with their performance tracked on websites or apps.

Although some have argued that fantasy sports sites could be hubs for illegal online gambling, supporters emphasize that it is based on skill rather than chance.

This is not the desired outcome for those hoping for legalized sports betting in Texas. However, it does provide them with the option of daily fantasy sports while waiting for such changes to be implemented.
